Agreement to Terms

By downloading or using Hearth, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the app.

Who We Are

Hearth is developed and published by Sodium Studio, LLC, a Massachusetts limited liability company. References to "we," "us," or "Sodium Studio" in these terms refer to Sodium Studio, LLC.

License to Use Hearth

Sodium Studio, LLC grants you a personal, non-exclusive, non-transferable, revocable license to use Hearth on any Apple device you own or control, subject to the App Store Terms of Service and these Terms of Use.

You may not:

  • Copy, modify, or distribute Hearth or any portion of it

  • Reverse engineer or attempt to extract the source code of the app, except as permitted by applicable law

  • Use Hearth for any unlawful purpose

  • Transfer your license to any other person

In-App Purchases

Hearth offers a single one-time in-app purchase to unlock unlimited records and properties. The free version of the app allows up to 5 records and 1 property. All purchases are processed by Apple through the App Store and are subject to Apple's App Store Terms of Service.

All purchases are final. Refund requests are handled by Apple in accordance with their refund policy. Sodium Studio, LLC does not issue refunds directly.

The unlock is a non-consumable in-app purchase. Once purchased, it is restored automatically on any device signed into the same Apple ID. Family Sharing is enabled — a single purchase covers all members of your Family Sharing group.

Your Data

All data you enter into Hearth is stored in your personal iCloud account. Sodium Studio does not have access to your data. You are solely responsible for the accuracy of the information you enter and for maintaining appropriate backups of your iCloud data.

We strongly recommend keeping iCloud Backup enabled to protect your Hearth data in the event of device loss or failure.

Accuracy of Information

Hearth is a personal organization tool. The information stored in Hearth is entered by you and maintained by you. Sodium Studio, LLC makes no representations about the accuracy, completeness, or fitness for any particular purpose of information stored within the app.

Hearth is not a substitute for professional advice. For legal, financial, insurance, or technical matters related to your home, please consult a qualified professional.

Disclaimer of Warranties

Hearth is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Sodium Studio, LLC does not warrant that:

  • Hearth will be uninterrupted or error-free

  • Defects will be corrected

  • Hearth is free of viruses or other harmful components

  • The results of using Hearth will meet your requirements

Limitation of Liability

To the fullest extent permitted by applicable law, Sodium Studio, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of goodwill, arising out of or related to your use of Hearth.

In no event shall Sodium Studio, LLC's total liability to you exceed the amount you paid for Hearth in the twelve months preceding the claim.

Intellectual Property

Hearth, the Hearth name, the Hearth logo, and all related graphics, designs, and content are the property of Sodium Studio, LLC and are protected by applicable intellectual property laws. You may not use any Sodium Studio, LLC trademarks or branding without prior written permission.

Updates and Changes to the App

Sodium Studio, LLC may update, modify, or discontinue Hearth at any time without notice. We will make reasonable efforts to maintain compatibility with current versions of iOS, but we do not guarantee that Hearth will be available indefinitely or on all future operating system versions.

Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will update the effective date at the top of this page. Your continued use of Hearth after changes are posted constitutes your acceptance of the updated terms. We encourage you to review these terms periodically.

Governing Law

These Terms of Use are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Massachusetts.

Apple's Standard EULA

As Hearth is distributed through the Apple App Store, Apple's standard End User License Agreement (EULA) also applies. You can review Apple's standard EULA at:

These Terms of Use supplement and do not replace Apple's standard EULA.

Severability

If any provision of these Terms of Use is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
